[미국] 미국 특허 명세서에서 참고 자료미국 특허 명세서에서 참고 자료는 해당 발명의 배경을 나타내거나 발명의 기술 상태를 도해하는 데에 이용된다. 참고 자료의 통합은 해당 발명이 속하는 기술 분야의 당업자가 발명과 관련된 정보를 중복해서 자료를 조사하는 상황을 방지하기 위해 이용된다.특히, 발명의 청구 범위를 지지하거나 적정한 공개에 필요한 필수적인 자료인 경우에는 참고 자료에 의해 통합될 수 있는 자료가 등록된 미국 특허 또는 승인된 미국 특허 출원서다.필수적이지 않은 주재료가 참고 자료에 의해 통합되어질 수 있는 자료는 등록된 미국 특허, 외국 특허, 특허 출원서, 비특허 간행물이다.미국 특허 명세서에는 "참고 자료에 의해 통합된 자료"라는 것을 명백하게 표시해야 한다. 다른 자료에서 인용된 단순한 참고자료로서는 불충분하기 때문이다.만약 최초 출원 명세서에 참고 자료로 자료를 통합할 의사를 표하지 않았다면 통합하기 위한 수정은 새로운 자료로 간주돼 출원일이 변경된다.참고자료에 사용되는 참고번호는 상위의 번호로서 일련번호인 것이 좋으며, 일관성 있게 참고 자료의 번호를 사용하는 것이 바람직하다.가능한 미래 시제보다 현재 시제를 사용하는 것이 좋다. 하지만 "must", "always", mandatory"와 같은 절대적 문구를 사용하지 않는 것이 바람직하다.
